section 01
INTRODUCTION AND ACCEPTANCE
1.1 About Earnvoy
Earnvoy Inc., Earnvoy Limited (Nigeria) and Earnvoy Limited (England and Wales) (each, as applicable, "Earnvoy," "we," "us," or "our") operate a peer-to-peer cross-border parcel delivery marketplace (the "Platform") that connects senders who wish to send parcels internationally with travelers who are already making a journey and are willing to carry a parcel for a fee.
The contracting entity is Earnvoy Inc. for users resident in Canada and Earnvoy Limited (Nigeria) for users resident in Nigeria and Earnvoy Limited (England and Wales) for users resident in the United Kingdom. Each entity’s address is set out in Section 16.5.
1.2 Acceptance of Terms
By accessing or using the Platform, including creating an account, browsing available trips, posting a parcel, accepting a match, or completing a delivery, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and Acceptable Use Policy, which are incorporated by reference.
If you do not agree to these Terms, you must not access or use the Platform.
1.3 Eligibility
To use the Platform, you must:
- (a) Be at least eighteen (18) years of age;
- (b) Have the legal capacity to enter into a binding contract in your jurisdiction of residence;
- (c) Complete the account and identity verification process described in Section 4.3;
- (d) Not be prohibited from using the Platform under applicable law or under these Terms;
- (e) Be a resident of a country in which Earnvoy currently offers service (at the effective date, Canada, Nigeria, and the United Kingdom).
1.4 Membership by Invitation
Earnvoy operates on an invitation-based membership model. Access to the Platform requires a valid invitation code, which may be obtained from an existing Earnvoy member or issued directly by Earnvoy. Invitation is a trust primitive of the Platform, not a marketing gate.
Earnvoy reserves the right to invite, decline to invite, or revoke invitations at its sole discretion, subject to applicable non-discrimination laws.
section 02
GOVERNING LAW AND JURISDICTION
2.1 Contracting Entity and Governing Law
If you reside in Canada, you contract with Earnvoy Inc. and these Terms are governed by the laws of Alberta and the federal laws of Canada applicable there. If you reside in Nigeria, you contract with Earnvoy Limited (Nigeria) at Suite 50, Swift Plaza, Aguwan Anaekwe Street, Wuye, FCT, Abuja, Nigeria, and these Terms are governed by Nigerian law. If you reside in the United Kingdom, you contract with Earnvoy Limited (England and Wales) at Flat 1, 1 Park Crescent, Wolverhampton, WV1 4PY, United Kingdom, and these Terms are governed by the law of the UK nation in which you reside. Each is a separate legal entity. Conflict-of-law rules are excluded only to the extent permitted by law.
2.2 Mandatory Consumer Rights
Nothing in these Terms excludes, restricts, or replaces rights or remedies that cannot lawfully be excluded, including applicable rights under Canadian provincial and federal consumer law, Nigeria’s Federal Competition and Consumer Protection Act 2018, and the UK Consumer Rights Act 2015. Any disclaimer, liability limit, choice-of-law term, or dispute procedure applies only to the extent permitted by those laws.
2.3 Complaints and Disputes
Before filing a claim, please contact legal@earnvoy.com and allow thirty (30) days for a good-faith response, unless urgent relief, a statutory deadline, or non-waivable law requires otherwise. Consumers may use any competent court, tribunal, ombudsman, regulator, or alternative dispute mechanism available under mandatory local law. No term requires a consumer to arbitrate, waive a class or representative remedy, or litigate outside the consumer’s home jurisdiction where such a requirement would be unlawful or unfair.
2.4 Business Users
A user acting wholly or mainly for business purposes may agree with Earnvoy in writing to a different governing law, forum, or arbitration process. No such arrangement applies to a consumer merely because the user earns a delivery fee.
section 03
THE PLATFORM AND SERVICES
3.1 Nature of the Platform
Earnvoy provides a technology platform that connects senders and travelers. Earnvoy is a marketplace facilitator, not a shipper, carrier, transportation service, or logistics provider. Earnvoy does not itself carry, transport, or deliver parcels.
The actual delivery of any parcel is performed by travelers acting in their individual capacity, not as employees, agents, or representatives of Earnvoy.
3.2 Trust Primitives
The Platform provides the following trust primitives:
- (a) Identity Verification. Users must complete identity verification through our third-party verification provider before being able to send or carry parcels.
- (b) Invitation-Based Membership. Access to the Platform is by invitation, as described in Section 1.4.
- (c) Conditional Payment Safeguarding. Sender payments are processed and, where applicable, conditionally held or safeguarded by the disclosed regulated payment, banking, or safeguarding provider under its terms. See Sections 7.1 and 7.4.
- (d) Flight Verification. Where a traveler stipulates a flight as the means of delivery, Earnvoy verifies the flight's existence and status at the moment of match acceptance through a third-party aviation data provider.
- (e) Handover and Delivery Verification. At the sender-to-traveler handover, the sender and traveler record the parcel’s condition and transfer of custody through the approved in-app process. At final delivery, the traveler and designated recipient separately record receipt through the approved confirmation process, which may include photographs, codes, signatures, and geolocation where lawful and enabled.
- (f) Dispute Resolution. Earnvoy provides an internal dispute resolution process as described in Section 12.
3.3 Changes to the Platform
Earnvoy reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. Earnvoy will use reasonable efforts to provide advance notice of material changes that affect existing transactions.
section 04
USER ACCOUNTS
4.1 Account Registration
To use the Platform, you must create an account and provide accurate, current, and complete information as prompted during registration. You agree to promptly update your account information to keep it accurate, current, and complete.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- (a) Use a strong, unique password;
- (b) Not share your account credentials with any third party;
- (c) Notify Earnvoy immediately at security@earnvoy.com of any unauthorized access to or use of your account;
- (d) Comply with any additional security measures Earnvoy may implement, including multi-factor authentication.
4.3 Account Verification
You may be required to complete additional verification steps beyond initial identity verification, including but not limited to residency verification when adding new corridors, address confirmation, and enhanced due diligence for high-value transactions.
4.4 One Account Per Person
You may only maintain one active account on the Platform. Creating multiple accounts, or creating an account after a prior account has been suspended or terminated, is a violation of these Terms.
section 05
SENDER OBLIGATIONS
5.1 Parcel Description
As a sender, you agree to accurately describe your parcel, including its contents, dimensions, weight, declared value, and any special handling requirements. Material misrepresentation is a violation of these Terms and may result in account restriction, cancellation, allocation or refund of transaction funds under Section 7.4, recovery of losses, and legal action where appropriate. Earnvoy will not confiscate user funds merely as a penalty.
5.2 Prohibited Items
You agree not to send any items prohibited under the Acceptable Use Policy or under applicable law in the sender's country, the traveler's country of origin, the destination country, or any transit country. See the Acceptable Use Policy for the specific list of prohibited items.
You are solely responsible for determining whether your parcel is permitted under all applicable laws and regulations, including customs, export controls, and import restrictions.
5.3 Payment
You agree to pay the total transaction amount displayed at match acceptance, which includes:
- (a) The delivery fee, which the traveler will receive upon successful delivery;
- (b) Earnvoy's platform commission, calculated as fourteen percent (14%) of the agreed traveler delivery fee, excluding duties, taxes, the FX spread, payout costs, refunds, and chargebacks;
- (c) FX conversion at the mid-market rate plus a spread of two and one-half percent (2.5%) for cross-border transactions requiring currency conversion;
- (d) Any payout cost exceeding the amount Earnvoy agrees to absorb under Section 7.3. The exact excess, currency, and resulting net traveler payout must be shown to the traveler before match acceptance. It will be deducted only from the traveler payout and will not be added to the sender’s price after acceptance.
Payment is required at the time of match acceptance. Failure to complete payment will result in match cancellation.
5.4 Sender's Representations and Warranties
You represent and warrant that:
- (a) You are the lawful owner of the parcel contents or have the lawful right to send them;
- (b) The parcel contents comply with all applicable laws;
- (c) You have accurately declared the parcel's contents, value, and any relevant characteristics;
- (d) You are not sending the parcel on behalf of any sanctioned person or entity, and the recipient is not a sanctioned person or entity;
- (e) You will provide accurate delivery instructions and be reachable during the delivery window.
5.5 Insurance and Liability
Earnvoy does not provide insurance for parcels sent through the Platform. Senders are responsible for arranging their own insurance if desired. Any traveler liability for loss, damage, or delay is addressed in Section 9.4.
section 06
TRAVELER OBLIGATIONS
6.1 Trip Posting
As a traveler, you agree to accurately describe your trip, including your route, dates, available capacity, and any restrictions. You must genuinely intend to make the trip you post.
6.2 Flight Verification
Where you stipulate a flight as the means of delivery, you agree that Earnvoy will verify the flight's existence and status at the moment of match acceptance through a third-party aviation data provider. You may be required to provide:
- (a) Flight number in industry-standard format;
- (b) Booking reference (PNR), which is optional but recommended;
- (c) Consent to real-time verification.
If the aviation data provider is temporarily unavailable at the moment of acceptance, you may consent to acceptance without verification, in which case Earnvoy's operations team will conduct manual review. You will be clearly notified when this occurs.
6.3 Custody of Parcel
You take custody only after completing the approved handover inspection. The approved inspection is a visual check of the parcel’s exterior, seals, packaging, label, declared description, apparent condition, dimensions, weight, and documents. You may ask the sender to open and display the contents while both parties are present and record the inspection through the Platform where lawful and reasonably necessary. You must not personally open a sealed parcel without the sender’s express consent or Platform direction. You may refuse the parcel before accepting custody if the sender refuses an approved inspection, the parcel differs from its listing, or you reasonably suspect a legal, customs, safety, packaging, or documentation problem. After accepting custody, you agree to:
- (a) Document the approved inspection, any sender-opened contents review, and the parcel’s condition through the Platform;
- (b) Not open the parcel after accepting custody, or alter, remove, add, substitute, or use any contents;
- (c) Keep the parcel with you or in secure storage at all times;
- (d) Complete delivery within the timeframe agreed at match acceptance.
6.4 Delivery
At delivery, you agree to:
- (a) Confirm the recipient's identity per Platform instructions;
- (b) Document the handover through in-app photograph and geolocation confirmation;
- (c) Obtain the recipient's confirmation through the Platform.
Successful delivery authorises Earnvoy to instruct the disclosed payment or safeguarding provider to release the traveler allocation, subject to Sections 7.1 and 7.4, provider processing, any pending dispute, lawful hold, chargeback, set-off, refund, or other permitted adjustment. Delivery confirmation does not mean that Earnvoy itself holds or automatically releases funds.
6.5 Traveler's Representations and Warranties
You represent and warrant that:
- (a) You are legally permitted to travel between the origin and destination;
- (b) You will not transport any prohibited items on behalf of the sender or any third party;
- (c) You will comply with all applicable customs, import, and export laws in every jurisdiction of travel;
- (d) You have no reason to believe the parcel contains prohibited items or contents different from those declared;
- (e) You are not on any sanctions list.
6.6 Cancellation
If you must cancel a confirmed match due to unforeseen circumstances, you must notify Earnvoy and the sender through the Platform as soon as reasonably possible. Repeated cancellations may result in account suspension.
If the traveler cancels before handover, Earnvoy will instruct the disclosed payment or safeguarding provider to return the available transaction funds to the sender in accordance with Section 7.4. The amount and timing remain subject to any lawfully retained and previously disclosed third-party charge, payment-provider processing, currency conversion or reversal mechanics, and mandatory law.
section 07
ESCROW AND PAYMENTS
7.1 Escrow Structure
When a sender completes payment at match acceptance:
- (a) Earnvoy's platform commission is deducted from the sender's payment;
- (b) The remainder is converted to the destination currency (for cross-border transactions) at the disclosed rate;
- (c) The amount allocated for the traveler is safeguarded or conditionally held by the disclosed regulated payment, banking, or safeguarding provider under that provider’s applicable terms; and
- (d) At successful delivery confirmation, the amount allocated to the traveler is released, less only a payout-cost excess disclosed and accepted under Section 7.3 and any lawful hold, reversal, set-off, or adjustment under these Terms.
Where the Platform describes funds as held, safeguarded, or in escrow, those funds are handled by the disclosed regulated payment, banking, or safeguarding provider under its applicable terms. Earnvoy does not represent that it is a bank, deposit-taker, money transmitter, or escrow institution and does not itself hold client money unless it is lawfully authorised to do so. Payment processing partners (including but not limited to Paystack and other providers) move funds between accounts; they do not hold escrow funds.
7.2 Currency Conversion
For cross-border transactions requiring currency conversion (currently CAD to NGN for Canada-to-Nigeria transactions):
- (a) The exchange rate applied is the mid-market rate at the time of transaction, plus a spread of two and one-half percent (2.5%);
- (b) The applied rate is disclosed to the sender at match acceptance;
- (c) No additional FX fees are applied.
7.3 Payout to Traveler
Upon successful delivery confirmation, the escrowed funds are released to the traveler's designated payout account within the payout estimate displayed before acceptance, subject to banking networks, verification checks, legal holds, chargebacks, and events outside Earnvoy’s reasonable control.
Earnvoy absorbs payout costs up to CAD 2 (or the displayed local-currency equivalent) per transaction. If the actual payout cost exceeds that amount, the excess may be deducted from the traveler payout only if the estimated excess and resulting net payout were clearly disclosed before match acceptance. Earnvoy bears any undisclosed excess. The sender is not charged an additional payout cost after match acceptance.
7.4 Refunds
Subject to mandatory law and payment-provider rules, transaction funds are handled as follows:
- (a) If the traveler cancels before handover, the sender receives a full refund of the delivery fee, commission, and unused FX amount. Any unavoidable third-party charge may be deducted only if it was disclosed before payment and may lawfully be retained;
- (b) If the sender cancels before traveler acceptance, the sender receives a full refund. If the sender cancels after acceptance but before handover, the sender receives the balance after any disclosed cancellation charge and unavoidable third-party cost permitted by law;
- (c) If flight verification fails before handover, or manual review rejects the flight, the match is cancelled and the sender receives a full refund, subject only to a disclosed and lawfully non-refundable third-party charge;
- (d) If delivery failure, parcel loss, or damage is attributable to the traveler, Earnvoy may refund all or part of the traveler delivery fee and commission to the sender and may hold or set off the corresponding traveler payout, without limiting Section 9.4;
- (e) If a parcel is detained, refused, returned, confiscated, destroyed, or assessed charges by customs or another authority, no refund is automatic. Earnvoy will allocate available funds after considering the cause, user responsibility, work already performed, recoverable third-party charges, evidence, payment-provider rules, and mandatory law. Sender misdescription, prohibited contents, or missing sender documents may reduce or eliminate the sender’s refund. Traveler non-compliance may support a sender refund;
- (f) After handover, a sender cancellation does not automatically produce a refund. Earnvoy may approve a full or partial refund where fair and lawful after reviewing performance, costs, mitigation, and evidence. Earnvoy will not retain commission for an unperformed transaction except to the extent a clearly disclosed charge reflects services already supplied and is permitted by law.
Approved refunds are returned to the original payment method unless law or the payment provider requires another method. The estimated processing time will be stated when the refund is approved; banks and payment networks may require additional time.
7.5 Taxes
You are responsible for determining and paying any taxes applicable to your use of the Platform in your jurisdiction. Earnvoy will provide reasonable tax documentation as required by law, including any statements or reporting documents that Earnvoy is legally required to provide.
section 08
FLIGHT VERIFICATION
8.1 Verification at Match Acceptance
Where a traveler stipulates a flight as the means of delivery, Earnvoy performs real-time verification of the flight's existence and status at the moment of match acceptance. This verification is a trust primitive of the Platform.
The verification confirms:
- (a) The flight number provided corresponds to an actual scheduled flight;
- (b) The flight is not cancelled;
- (c) The flight is scheduled to operate on the date specified.
The verification does not confirm that the traveler holds a seat on the flight, and does not verify the traveler's individual presence on the flight.
8.2 Verification Outcomes
Verification produces one of four outcomes:
- (a) Verified. The flight exists and is operating as scheduled. Match acceptance proceeds normally.
- (b) Not Found. No flight matching the provided details exists. Match acceptance is blocked. The traveler is prompted to correct the flight information or cancel the trip.
- (c) Cancelled. The flight exists but has been cancelled by the airline. Match acceptance is blocked. The traveler is prompted to update the flight information or cancel the trip.
- (d) Outage. The aviation data provider is temporarily unavailable. The traveler may consent to acceptance without automated verification, in which case Earnvoy's operations team conducts manual review.
8.3 Re-Verification
For subsequent matches on a previously verified flight, Earnvoy performs a lightweight re-check to detect cancellations that may have occurred after initial verification. This re-check blocks match acceptance if a cancellation is detected.
8.4 Manual Review
Where match acceptance proceeds under outage-consent, Earnvoy's operations team conducts manual review of the flight. Manual review may result in:
- (a) Confirmation of the flight (match proceeds normally);
- (b) Rejection of the flight (match is cancelled, sender is refunded);
- (c) Request for the traveler to re-enter flight information;
- (d) Retry of the automated verification.
Manual review confirmation does not retroactively mark the flight as system-verified. It is recorded as reviewer-confirmed, a distinct verification state.
section 09
LIABILITY AND DISCLAIMERS
9.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. Earnvoy specifically disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
9.2 No Warranty of Traveler Performance
Earnvoy does not warrant the performance, reliability, or trustworthiness of any specific traveler. Trust primitives (identity verification, flight verification, escrow, handover documentation) are provided to reduce risk but do not eliminate it.
9.3 Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Earnvoy, its officers, directors, employees, agents, or affiliates be liable for:
- (a) Any indirect, incidental, special, consequential, exemplary, or punitive damages;
- (b) Loss of profits, revenue, data, use, goodwill, or other intangible losses;
- (c) Damages resulting from the acts or omissions of any traveler, sender, or third party;
- (d) Damages exceeding the amount you paid to Earnvoy in the twelve (12) months preceding the event giving rise to the claim, or one hundred Canadian dollars (CAD 100), whichever is greater.
The limitations in this section apply to the fullest extent permitted by law and do not apply where such limitations are prohibited by applicable law, including non-waivable consumer protection rights.
9.4 Traveler Liability for Parcel Loss or Damage
A traveler is responsible for proven direct parcel loss, damage, or non-delivery caused by the traveler’s breach, negligence, fraud, or willful misconduct. The recoverable amount will not exceed the sender’s proven direct loss and ordinarily will not exceed the declared value that the traveler accepted before handover. No lower fixed cap applies unless the Platform clearly displays that cap before match acceptance and the cap is lawful. No cap limits liability for fraud, deliberate misconduct, or any liability that cannot lawfully be limited.
Travelers are not liable for loss or damage caused by force majeure events (Section 15), acts of third parties beyond their control, or inherent characteristics of the parcel contents.
9.5 Indemnification
You agree to indemnify, defend, and hold harmless Earnvoy, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- (a) Your violation of these Terms;
- (b) Your violation of any applicable law;
- (c) Your violation of the rights of any third party;
- (d) Your use of the Platform;
- (e) Content you post or transactions you conduct on the Platform;
- (f) Any misrepresentation of parcel contents or trip details.
section 10
PROHIBITED CONDUCT
You agree not to:
- (a) Use the Platform for any illegal purpose or in violation of any applicable law;
- (b) Send or attempt to send prohibited items (see the Acceptable Use Policy);
- (c) Misrepresent your identity, parcel contents, or trip details;
- (d) Circumvent identity verification or invitation-based membership;
- (e) Interfere with, disrupt, or damage the Platform or its infrastructure;
- (f) Attempt to gain unauthorized access to any accounts, systems, or data;
- (g) Use automated means to access the Platform without our express written consent;
- (h) Reverse engineer, decompile, or disassemble any aspect of the Platform;
- (i) Harvest, collect, or store personal information about other users;
- (j) Contact other users outside the Platform for purposes of circumventing Platform fees;
- (k) Post or transmit any content that is illegal, harmful, threatening, harassing, defamatory, or infringes any intellectual property or privacy right;
- (l) Impersonate any person or entity;
- (m) Use the Platform to launder money, evade taxes, or engage in any other financial crime.
Violation of this Section may result in account suspension, termination, transaction cancellation, a hold, release, refund, or set-off of pending funds in accordance with Section 7 and applicable law, recovery of losses, and legal action. Earnvoy will not confiscate pending funds merely as a penalty.
section 11
INTELLECTUAL PROPERTY
11.1 Platform Ownership
All rights, title, and interest in and to the Platform, including all software, designs, text, images, and other content (excluding user content), are owned by Earnvoy or its licensors and are protected by copyright, trademark, and other intellectual property laws.
11.2 Limited License
Subject to your compliance with these Terms, Earnvoy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your own lawful use, including earning or paying a delivery fee through transactions expressly permitted by the Platform. This license does not permit resale of Platform access, commercial exploitation of Platform content or data, scraping, or operation of an unauthorised delivery or brokerage service through the Platform.
11.3 User Content
You retain ownership of any content you post to the Platform (photographs, descriptions, messages). By posting content, you grant Earnvoy a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display the content solely for the purpose of operating and improving the Platform.
You represent and warrant that you have all necessary rights to post such content.
11.4 Trademarks
"Earnvoy" and the Earnvoy logo are trademarks of Earnvoy Inc. You may not use these trademarks without our prior written consent.
section 12
DISPUTE RESOLUTION BETWEEN USERS
12.1 Internal Dispute Process
Disputes between senders and travelers regarding parcel handling, delivery, damage, or non-delivery should first be raised through the Platform's internal dispute resolution process:
- (a) Report the dispute through the Platform within seven (7) days of the delivery date or scheduled delivery date;
- (b) Provide evidence supporting your position (photographs, messages, receipts);
- (c) Cooperate with Earnvoy's dispute resolution team;
- (d) Await determination.
12.2 Earnvoy's Role in Disputes
Earnvoy will review disputes in good faith based on evidence provided by both parties and information available through the Platform. Earnvoy's determination may result in:
- (a) Release of escrow to the traveler;
- (b) Return of escrow to the sender;
- (c) Partial refund;
- (d) Referral to external dispute resolution or law enforcement, as appropriate.
Earnvoy's determination is binding for purposes of the escrow release but does not preclude either party from pursuing external remedies.
12.3 External Remedies
Nothing in this section limits your right to pursue external remedies through a competent court, tribunal, regulator, ombudsman, or other dispute mechanism available under applicable law, subject to Section 2.3 and any lawful filing deadline.
section 13
TERMINATION
13.1 Termination by You
You may terminate your account at any time through the Platform's account settings or by contacting support@earnvoy.com. Termination does not release you from obligations under active transactions.
13.2 Termination by Earnvoy
Earnvoy may suspend or terminate your account at any time, with or without notice, for:
- (a) Violation of these Terms or the Acceptable Use Policy;
- (b) Fraud, dishonesty, or misrepresentation;
- (c) Failure to complete or maintain identity verification;
- (d) Regulatory requirement or legal obligation;
- (e) Extended inactivity of twelve (12) months or more;
- (f) Repeated cancellations, disputes, or negative reviews;
- (g) Any conduct that Earnvoy determines, in its reasonable discretion, poses a risk to the Platform or other users.
13.3 Effect of Termination
Upon termination:
- (a) Your right to access the Platform ends immediately;
- (b) Any active transactions will be resolved per these Terms;
- (c) Any funds owed to you will be paid subject to normal payout procedures;
- (d) Any funds owed by you remain due;
- (e) Provisions of these Terms that by their nature should survive termination (including Sections 2, 9, 10, 11, 14, and 15) will survive.
13.4 Data Retention After Termination
After termination, Earnvoy will retain personal data only as described in the Privacy Policy and for applicable legal, tax, accounting, anti-money-laundering, payment, fraud-prevention, dispute, or recordkeeping purposes. A FINTRAC or equivalent retention period applies only where Earnvoy or the relevant service provider is legally subject to that regime.
13A. CUSTOMS, BORDER AND MARKETPLACE RISK
13A.1 Independent Customs Duties
Senders and travelers must independently verify the rules for every origin, transit, and destination country. The sender is responsible for a truthful item description, value, supporting documents, and any export requirements. The traveler remains personally responsible for deciding whether to accept a parcel and for declarations required of a person carrying goods. Earnvoy does not act as customs broker, freight forwarder, carrier, importer of record, or exporter of record.
13A.2 Inspection, Refusal, Seizure and Charges
A traveler may refuse a parcel before handover if its contents, packaging, documentation, or apparent value do not match the listing or create a legal or safety concern. Border authorities may inspect, delay, confiscate, destroy, return, or assess duties, taxes, penalties, or storage charges. Allocation of transaction funds in those events will follow the disclosed cancellation/refund rules, evidence available, responsibility for the event, payment-provider rules, and mandatory law.
13A.3 No Guarantee
Earnvoy does not guarantee clearance, admission, delivery time, airline acceptance, or recovery of a detained parcel. Platform screening and flight verification reduce risk but do not confirm contents, legal admissibility, a traveler’s boarding, or customs clearance.
section 14
CHANGES TO THESE TERMS
Earnvoy may modify these Terms at any time. When we make material changes, we will:
- (a) Provide notice through the Platform, by email, or both, at least thirty (30) days before the changes take effect;
- (b) Indicate the effective date of the revised Terms;
- (c) Provide an opportunity to review the changes before continued use.
Your continued use of the Platform after the effective date of revised Terms constitutes acceptance of those changes. If you do not agree to the changes, you must terminate your account before the effective date.
section 15
FORCE MAJEURE
Neither party is liable for failure to perform its obligations under these Terms to the extent such failure results from causes beyond its reasonable control, including:
- (a) Acts of God, natural disasters, pandemics;
- (b) War, terrorism, civil unrest;
- (c) Government action, sanctions, currency controls;
- (d) Regulatory changes affecting the Platform;
- (e) Third-party service provider outages (including but not limited to aviation data providers, payment processors, identity verification providers);
- (f) Flight cancellations, delays, or route changes affecting delivery;
- (g) Failure of internet, telecommunications, or utilities.
The party affected by a force majeure event will notify the other party as soon as reasonably possible and take reasonable steps to mitigate the effect.
section 16
MISCELLANEOUS
16.1 Entire Agreement
These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Earnvoy regarding the Platform and supersede all prior agreements, representations, and understandings.
16.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be interpreted to give effect to its intended purpose to the extent permitted by law.
16.3 Waiver
Earnvoy's failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. No waiver is effective unless in writing and signed by an authorized representative of Earnvoy.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without Earnvoy's prior written consent. Earnvoy may assign these Terms in connection with a merger, acquisition, or sale of assets, or as otherwise permitted by law.
